Is there a digital nomad visa for the USA?

Nope. The US does not have a digital nomad visa. Not in 2026, and no bill in Congress would create one.

Kind of wild when you think about it. Spain has one. Portugal, Estonia, Japan, South Korea, Thailand. Around 60 countries have built digital nomad visas since 2020. The US just never bothered.

So what do remote workers actually do?

If you are a US citizen, you do not need anything. Pick a state, open your laptop, done. That is the whole point of this site. I compare 14 US cities on real rent, internet, and walkability data so you can pick yours with actual numbers instead of vibes.

If you are not a US citizen, your options are limited and honestly kind of bad:

Why doesn’t the US have one?

US immigration law goes through Congress, and Congress barely moves on immigration at all. Only Congress can create a new visa category, and no digital nomad visa bill has gotten any real traction. Other countries looked at remote workers, saw an economic win, and moved fast. The US is losing a talent competition it never entered.

What I would actually do

  1. American? Pick a no-income-tax state and set up domicile plus mail forwarding. I wrote the full comparison: South Dakota vs Texas vs Florida.
  2. Not American? Talk to an immigration attorney before working from US soil. Working on tourist status can get you turned away at the border, and lying about your plans can make you permanently inadmissible. The 3- and 10-year bans only kick in if you overstay your authorized period by 180+ days and then leave. Not a risk I would take.
  3. American living abroad? The US taxes citizens everywhere, but the Foreign Earned Income Exclusion ($132,900 for 2026, per the IRS) can wipe out a big chunk if you pass the physical presence test: 330 full days in a foreign country during a 12-month period.

This is general information, not legal advice. Immigration is fact-specific, so talk to a lawyer about your situation.

Questions people ask

Does the US have a digital nomad visa in 2026?

No. There is no digital nomad visa, and no bill creating one is moving in Congress.

Can I work remotely in the US on ESTA?

ESTA covers business activities like meetings and conferences, not work. Remote work for a foreign employer lives in a legal gray area that border officers treat as a violation. Entry is always the officer’s call.

Which countries have digital nomad visas?

Spain, Portugal, Estonia, Japan, South Korea and Thailand all run nomad visa programs. Croatia offers a temporary residence permit for remote workers rather than a visa, and Germany’s route is a freelance residence permit rather than a standalone nomad visa. Dozens more exist. The US is a strange holdout among large economies.

Can a US citizen be a digital nomad domestically?

Yes, no visa needed. Your real decisions are tax domicile, mail forwarding, and health insurance across state lines. Start with the city comparisons.

Will the US ever create a digital nomad visa?

Nobody knows. There is no current legislation, and Congress is gridlocked on immigration generally. I would not plan around it showing up soon.
